A New Jersey man was sexually assaulted by a hospital employee, who was already the subject of a police investigation for a similar assault six weeks prior. The attorney requested a behavioral expert to address the propensity for an individual to commit repeated sexual assaults. A medQuest psychiatrist specializing in sexual abuse reported that the standard of care for the hospital was to act immediately after the first assault, documenting it appropriately and then either re-assigning the employee to non-patient duties or by suspending the employee until the police investigation was completed.
